Terms and Conditions.

This agreement is entered into between MPIS, Inc RentersCheck.com Corporation (a wholly owned subsidiary of MPIS, Inc RentersCheck.com Holdings, Corporation). 
a West Virginia corporation and the entity first set forth have 
mutually agreed to terms and conditions as follows: 
	
 1.SERVICE  
   MPIS, Inc RentersCheck.com Corporation provides nationwide    public record information and    related ("Services") using its proprietary databases and information obtained from third parties 
   ("Third Parties"). This information is delivered through MPIS, Inc RentersCheck.com Inc.™ via the      Internet. User hereby subscribes to Services for use as a factor in making business decisions 
   and agrees to pay MPIS, Inc RentersCheck.com Corporation the applicable rates and charges set    forth in Paragraph 3 below. 
	
 2.PERFORMANCE 
   MPIS, Inc RentersCheck.com Corporation will use its best efforts to deliver 
   Services requested by User in an expeditious and efficient 
   manner and to regularly access, update, augment, and maintain 
   its compilation of information gathered from selected public 
   records and other sources used in the provision of Services 
   hereunder. User accepts all information AS IS. 
	
 3.CHARGES TO USER  
   For each response to a request for information, including 
   "no record found", User agrees to pay MPIS, Inc RentersCheck.com the 
   applicable charge then prevailing for Services rendered 
   to User. MPIS, Inc RentersCheck.com reserves the right to discount  
   "no record found" responses. User shall pay to 
   MPIS, Inc RentersCheck.com prices as updated from time to time 
   through on-line announcements, bulletins, and published 
   price schedules. All current and future MPIS, Inc RentersCheck.com 
   pricing documents are deemed incorporated herein. 
	
 4.USER LIMITATIONS OF USE 
   User acknowledges that MPIS, Inc RentersCheck.com Corporation and/or 
   Third Parties retain all right, title and interest under 
   applicable copyright and related laws in the databases 
   and materials contained therein used to provide Services 
   hereunder, and User shall use such materials consistent 
   with such right, title and interest and notify MPIS, Inc RentersCheck.com 
   Corporation of any threatened or actual infringement 
   thereof. User further acknowledges that this Agreement 
   grants user a limited license in exchange for payment 
   of fees and charges set forth in Paragraph 3 hereof and 
   user shall not reproduce, retransmit, publish or otherwise 
   transfer for commercial exploitation any information that 
   User receives from Services. Upon approval of intended 
   use(s) by MPIS, Inc RentersCheck.com Inc., User agrees to limit 
   re-dissemination of information from Services solely to 
   use(s) set forth under Industry Type(s) on the new user 
   application form. User shall at no times represent that 
   it is an authorized agent or representative of MPIS, Inc RentersCheck.com 
   Corporation or any Third Party unless such written 
   agreement has been established. 	
 
 5.NEGATION OF LIABILITY/WARRANTY  
   Neither MPIS, Inc RentersCheck.com Corporation nor third parties shall be 
   liable to user or to any person claiming through user or 
   to whom user may have provided service-related data for 
   any loss or injury arising out of or caused in whole or 
   in part by MPIS, Inc RentersCheck.com Corporation or third parties negligent 
   acts or omissions in procuring, compiling, collecting, 
   interpreting, reporting, communicating, or delivering 
   services or in otherwise performance of this agreement. 
   MPIS, Inc RentersCheck.com Corporation and/or third parties do not guarantee 
   or warrant the correctness, completeness, currency, 
   merchantability, or fitness for a particular purpose of 
   the services or the components thereof. 
	
 6.AGREEMENT ENTIRETY  
   This agreement sets forth the entire understanding and 
   Agreement between MPIS, Inc RentersCheck.com Corporation and User. 
   By receipt of Services, User agrees to, and shall comply 
   with, such different and /or additional terms of third 
   parties and such changes in this Agreement, as MPIS, Inc RentersCheck.com 
   Corporation shall make from time to time by notice to User. 
   This Agreement shall be interpreted in accordance with the 
   laws of the Commonwealth of West Virginia. Violation by 
   user of state or federal laws, or MPIS, Inc RentersCheck.com Inc.'s or 
   Third Parties' established policies and procedures might 
   result in immediate termination of this Agreement in 
   MPIS, Inc RentersCheck.com Inc.'s sole discretion.  
	
 7.PAYMENT OF FEES  
    User shall be responsible for payment for all services 
    obtained through User's access identification code. 
    Payment by subscriber is due and payable upon invoice. 
    If payments are past due more then ten-(10)-days 
    from the date of invoice, MPIS, Inc RentersCheck.com Corporation may 
    interrupt service. If payments are past due more than 
    30 days, MPIS, Inc RentersCheck.com Corporation may terminate this 
    Agreement. User is responsible for all collection costs 
    and attorney fees incurred by MPIS, Inc RentersCheck.com Corporation 
    through its efforts to collect on balance(s) owed by User. 
    MPIS, Inc RentersCheck.com may us all means available
    to collect information on me if I the member fail to pay after
    45 days.
	
 8.COMPLIANCE WITH LAWS
   User acknowledges that this Agreement grants User a limited 
   license in exchange for payment, and User shall not reproduce, 
   retransmit, republish or otherwise transfer for commercial 
   purpose any information received from Services, except for 
   duties reasonably related to the legitimate business purposes 
   for which the information is requested. User warrants that 
   it is the end user of the information. User agrees to limit 
   use and dissemination of information from Services solely 
   for normal course of business. Uses outside of the normal 
   course of business include without limitation: accessing or 
   using information on public figures, including names in the 
   news, media personalities, political personalities, etc., 
   unless used for the completion of a documented business 
   transaction. 
   a.	FAIR CREDIT REPORTING ACT. 
        User agrees to use credit reports only in a lawful manor
        under all FCRA laws, state laws, and federal laws. User
        May or may not have access to credit reports without a
        signed agreement between user, and MPIS, Inc RentersCheck.com

Members/Subscriber

PARTS OF FCRA AND LAWS YOU AGREE TO AS A MEMBER.

1.	Reseller has access to consumer reports from one or more consumer credit reporting agencies.

2.	Subscriber has a permissible purpose for obtaining consumer reports, as defined by Section 604 of the Federal Fair Credit Reporting Act (15 USC 1681b) as amended by the Consumer Credit Reporting Reform Act of 1996, hereinafter called “FCRA.”  

The subscriber certifies their permissible purpose as:

In connection with a credit transaction involving the consumer on whom the information is to be furnished and involving the extension of credit to, or review or collection of an account of the consumer; or

In connection with the underwriting of insurance involving the consumer or review of existing policy holders for insurance underwriting purposes, or in connection with an insurance claim where written permission of the consumer has been obtained; or

In connection with a tenant screen application involving the consumer; or

In accordance with the written instructions of the consumer; or

For a legitimate business need in connection with a business transaction that is initiated by the consumer; or

As a potential investor, servicer or current insurer in connection with a valuation of, or assessment of, the credit or prepayment risks.


3.	Subscriber certifies that it will request consumer reports pursuant to procedures prescribed by Reseller from time to time only for the permissible purpose certified above, and will use the reports obtained for no other purpose.

4.	Subscriber will maintain copies of all written authorizations for a minimum of three (3) years from the date of inquiry.

5.	THE FCRA PROVIDES THAT ANY PERSON WHO KNOWINGLY AND WILLFULLY OBTAINS INFORMATION ON A CONSUMER FROM A CONSUMER REPORTING AGENCY UNDER FALSE PRETENSES SHALL BE FINED UNDER TITLE 18, OR IMPRISONED NOT MORE THAN TWO YEARS, OR BOTH.

6.	Subscriber shall use each consumer report only for a one-time use and shall hold the report in strict confidence, and not to disclose it to any third parties; provided, however, that Subscriber may, but is not required to, disclose the report to the subject of the report only in connection with an adverse action based on the report.  Moreover, unless explicitly authorized in this Agreement or in a separate agreement, between Reseller and Subscriber, for scores obtained from Trans Union LLC, Equifax, or Experian, or as explicitly otherwise authorized in advance and in writing by Trans Union LLC, Experian, or Equifax, through Reseller, Subscriber shall not disclose to consumers or any third party, any nor all such scores provided under this Agreement, unless clearly required by law.

7.	With just cause, such as delinquency or violation of the terms of this contract or a legal requirement, Reseller may, upon its election, discontinue serving the Subscriber and cancel this Agreement immediately.

USER AGREES TO ALL FCRA AND CONSUMER CREDIT REPORT LAWS BY LOCAL LAWS, STATE LAWS, US LAWS, AND NATIONWIDELAWS.


   b.	DRIVER'S PRIVACY PROTECTION ACT. 
        User agrees to use Services, which is the subject of 
        this Agreement, in strict compliance with the Federal 
        Drivers Privacy Protection Act 
        (18 U.S.C. Section 2721 et seq.) and similar state 
        statutes, if applicable.
   c.	GRAMM-LEACH-BLILEY ACT. 
        User agrees to use Services, which is the subject 
        of this Agreement, in strict compliance with the 
        Gramm-Leach Bliley Act (U.S.C. Title 15, Chapter 94, 
        Section 6801 et seq.) and similar state statutes, 
        if applicable
	
 INDEMNIFICATION  
   User hereby agrees to protect, indemnify, defend, and hold 
   harmless MPIS, Inc RentersCheck.com Corporation and all Third Parties from 
   and against any and all costs, claims, demands, losses, and 
   liabilities (including actual attorneys' fees) arising from 
   or in any way related to use of information by User (or any 
   third party receiving such information from or through User) 
   furnished by or through MPIS, Inc RentersCheck.com Corporation to the extent 
   such costs, claims, demands, damages, losses, or liabilities 
   (including attorneys fees) do not result from the improper 
   acts or omissions of MPIS, Inc RentersCheck.com Corporation or Third Parties. 
   Provisions hereof related to release of claims, 
   indemnification, use of information, and data, payment for 
   Services and disclaimer of warranties shall survive any 
   termination of this Agreement.
